The 2021 session included meetings of the Adminstrative and Legal Committee, the Consultive Committee, and the Council.

A new section III «Options for the enforcement of breeders’ rights in relation to essentially derived varieties» was inserted in the draft «Explanatory Notes on Essentially Derived Varieties under the 1991 Act of the UPOV Convention» and provides options for the titleholders for the enforcement of their breeders rights. But, how titleholders enforce their rights is not part of the UPOV Convention – and should therefore not be part of an explanatory note on EDVs.

The commentary was prepared jointly and with the support of Food Sovereignity Ghana. It clarifies that Clause 22 of the Plant Variety Protection Act of Ghana clearly contradicts Art. 18 of UPOV 1991. It is therefore incomprehensible how the Office of the Union can come to the conclusion that the changes introduced in the Act during the parliamentary procedure do not affect the substantive provisions of the 1991 Act of the UPOV Convention.
